VA fiduciary
An individual or entity that the Department of Veterans Affairs appoints to receive and manage a beneficiary's VA benefits. VA appoints one after a VA rating authority finds the beneficiary unable to manage VA benefits, after a court finds the beneficiary unable to manage financial affairs, or when the beneficiary is a minor. The VA incompetency rating is an administrative decision, with notice and a hearing right, and doubt is resolved in favor of competency. The role ends through removal by the VA Hub Manager: when VA rates the beneficiary competent, when the beneficiary dies, when a successor is appointed, or when the fiduciary is removed for cause or withdraws with VA's permission.
- Assigned
- VA rating authority rates the beneficiary incompetent to handle VA funds, or a court with jurisdiction finds the beneficiary unable to manage financial affairs. The Hub Manager then investigates and appoints a fiduciary. Incapacitated
- Starts
- Hub Manager appoints the fiduciary; VA pays benefits to the fiduciary for the use and benefit of the beneficiary and dependents Incapacitated
- Ends
- Beneficiary dies: this is a listed reason for removal, and VA benefits are discontinued as of the last day of the month before death Deceased
- VA rating authority determines the beneficiary can manage VA benefits (or a court finds this, if the court order was the basis) Capable
- Removal for fiduciary reasons (misuse, failure to account, bar under 13.130, loss of qualifications, etc.), or withdrawal after VA arranges a successor Incapacitated
