Legal representative of a deceased taxpayer (CRA)
The Income Tax Act defines a deceased taxpayer's legal representative as the executor, administrator, liquidator, heir or similar fiduciary dealing with the estate. That person files the final return (due by the later of the normal due date and six months after death, for deaths after October). They must get a clearance certificate before distributing property, or they are personally liable for unpaid tax.
- Assigned
- Appointment under provincial law (executor named in a will, court-appointed administrator/estate trustee, Quebec liquidator). The CRA registers the person on receiving the death certificate and the will, grant or letters, or Form RC552 if there is no will. Deceased
- Starts
- On death. The statutory filing duty falls on the legal representatives. CRA access to the deceased's tax records follows once the documents are processed. Deceased
- Ends
- Tax liabilities settled and a clearance certificate obtained before final distribution. Distributing without one makes the representative personally liable up to the value distributed. Estate closed
- The provincial fiduciary office ends (removal, renunciation, replacement). CRA representation follows the underlying appointment. Estate administration

Legal representative of a living taxpayer who cannot act (CRA)
If an individual cannot file their own return, the Income Tax Act lets their guardian, committee or other legal representative file it. The CRA recognises as legal representative a person appointed by a legal document: a court-appointed guardian, trustee or committee, a person named in a power of attorney, or a representative under a BC-style representation agreement. The authority comes from, and ends with, that provincial instrument.
- Assigned
- Provincial instrument or order: power of attorney, representation agreement, or court appointment as guardian/trustee/committee Capable
- Starts
- When the underlying instrument is in effect and the CRA has received a copy (Represent a Client RepID linked to the taxpayer). The statutory filing role applies when the person cannot file for any reason. Incapacitated
- Ends
- Taxpayer dies: the living-person authority ends under provincial law and the estate's legal representative takes over. CRA says only a legal representative's access ends on notice of death. Deceased
- Underlying POA/guardianship is revoked or terminated under provincial law Capable

Fiduciary of record with the IRS (Form 56 notice)
Federal tax law does not create fiduciary authority. It recognizes a fiduciary (guardian, conservator, executor, administrator, trustee, or anyone else acting in a fiduciary capacity) once that person notifies the IRS, usually on Form 56. From then on, the fiduciary stands in the taxpayer's shoes for tax matters until notice is given that the fiduciary capacity has terminated. That IRS-facing status can therefore outlast the state-law appointment until termination is reported. An agent under a power of attorney is not a fiduciary for this purpose and uses Form 2848 instead.
- Assigned
- Person begins acting for another in a fiduciary capacity under other law (e.g., court appointment as guardian or conservator, letters testamentary or of administration, or trusteeship) Incapacitated
- Starts
- Notice of the fiduciary relationship is filed with the IRS (Form 56) Estate administration
- Ends
- Notice is given to the IRS that the fiduciary capacity has terminated (Form 56, Part II) Estate closed
