Personne chargée de l'exécution des directives — Person charged with executing post-mortem data directives

France lets a person say in advance what happens to their personal data after death, and name someone to carry that out. General directives may be lodged with a CNIL-certified digital trusted third party; particular ones go to the controller and need specific consent that cannot come from accepting terms of service. Art. 85 gives the designated person standing but prescribes no way of proving it: the implementing decree sets a proof rule for heirs only, so in practice the designation has to be evidenced by whatever holds the directives — the controller itself for directives particulières.

Assigned
Person defines general or particular directives on the conservation, erasure and communication of their personal data after death, and may designate a person charged with executing them Capable
Starts
On death the designated person may read the directives and require the controllers concerned to implement them — standing the article confers without prescribing how it is proved; failing a designation, or if the designee has died, the heirs have that standing Deceased
Ends
Directives modified or revoked by the person at any time Capable
Directives implemented by the controllers Deceased
Controller declines for want of proof that the claimant is the designated person — no evidentiary route is prescribed for the designee, unlike the heir Deceased
